Terms and Conditions
1. Bookings

i. The working day is usually 8 hours between 9.00am and 6.00pm and includes a half hour break (Shops Act 1950) (food and drink to be provided by the client). Bookings are charged by the hour (2 hr minimum), half day or full day

ii. Overtime rate is normal time and a half between 6.00pm and 12.00am and on Saturdays. Sundays and Bank Holidays are charged at double the normal rate

iii. Travel expenses are charged in addition to the model's fee and are usually charged from the model's residential address in the UK, to the location and return

iv. Fittings fees are half the normal hourly rate. Minimum booking 2 hours

v. Weather permitting/location bookings - cancellation at half fee unless model arrives at the location where full cancellation fee will be charged

vi. Restricted use of photographs will be negotiated by CELSIUS MODELS LIMITED at the time of booking

vii. Provisional bookings will be cancelled if not confirmed within 48 hours of the original enquiry in writing

viii. Whilst every reasonable endeavour is made to provide a satisfactory and efficient service to our clients, we cannot be held responsible for a model's conduct on an assignment nor any loss, financial or otherwise, howsoever caused

ix. CELSIUS MODELS LIMITED is not responsible for any costs incurred due to the lateness of a model on an assignment

x. VAT will be added to the invoice where appropriate as lawfully required by HM Customs & Excise

2. Cancellations

Bookings cancelled within 5 working days of the booking will be charged at 50% and if cancelled within 4 days or less will be charged at the full fee quoted.

3. Agency fees

i. Model fees, travel expenses and VAT (if applicable), will be invoiced by the agent

ii. All fees must be paid within 7 days following the assignment date, unless previously agreed

iii. The person making the booking will be invoiced and solely responsible for payment unless we are notified otherwise at the time of the booking. All fees are for the right to use pictures and once agreed are payable whether or not the use is appropriated. No use of pictures is permitted unless and until all relevant fees have been paid

4. Insurance

i. The client is responsible for the model's health and safety when the model is travelling, or providing a service in connection with the booking to the same extent as if the model were an employee of the client. The client will maintain adequate insurance cover to underwrite its obligations to the model

ii. It is the client's responsibility to arrange insurance if indemnity is required against a model's inability to attend through illness or unforeseen circumstances

5. Copyright

i. The photographer/client may only use the images taken during the assignment for the forms agreed at the time of booking

ii. Additional fees are liable when photographs (or reproductions and adaptations of part or complete picture) are used for other purposes than those originally commissioned. The client is wholly responsible for notifying CELSIUS MODELS LIMITED of any changes to this commission

iii. Unless otherwise arranged fees quoted are generally for the UK only, for 1 year from the date of booking

6. Complaints

i. Any cause for complaint must be reported within 3 hours of the booking. Complaints cannot be considered in retrospect, nor can we be held responsible for any extra expenses incurred

ii. These terms and conditions and all matters concerned with the booking are governed by English law and any dispute will be settled in accordance with that law by a Court in England

7. FUTURE WORK WITH THE SAME MODEL

The client confirms that if at any time in the future they wish to directly employ any of the models introduced to them through CELSIUS MODELS LIMITED, in any capacity whatsoever, this must be with written consent of CELSIUS MODELS LIMITED and subject to our normal commission rate of 20%.

CELSIUS MODELS LIMITED reserves the right to negotiate within the structure of these terms and conditions.
